Terms of Service

1. Acceptance of Terms

By creating an account or using any part of the SNotes service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.

2. Description of Service

SNotes is a privacy-first note-taking application hosted and operated entirely within the European Union. We provide tools to create, organize, and manage personal and professional notes. The Service is provided "as is" and may be updated, changed, or discontinued at any time with reasonable notice.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Be at least 16 years old to use the Service

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit malware, spam, or other harmful content
• Attempt to gain unauthorized access to our systems or other accounts
• Use automated tools to access or scrape the Service without written consent

5. Privacy & Data Protection

Your privacy is core to what we do. Our Privacy Policy describes how we collect, use, and protect your data in accordance with the GDPR. By using the Service, you agree to our Privacy Policy, which is incorporated into these Terms by reference.

6. Intellectual Property & Uploaded Media

All content you create, upload, and store in SNotes ("Your Content"), including notes, text, attachments, images, and other media, remains yours. You retain full ownership of your notes and data at all times.

Rights to Uploaded Media: You must hold all necessary rights, licenses, consents, and permissions for any media, files, or content you upload to or store on the Service. Uploading, storing, or sharing content that infringes upon third-party copyrights, trademarks, privacy rights, or other proprietary rights is strictly prohibited.

Compliance with Austrian Law: Only media and content that is fully legal under Austrian law is permitted on the Service. The upload, storage, or transmission of illegal material (including, without limitation, hate speech, unlawful depictions, copyright-infringing works, or any content prohibited by Austrian criminal or civil law) is strictly prohibited. We reserve the right to remove non-compliant content and suspend or terminate offending accounts.

The SNotes application, including its design, code, and branding, is the intellectual property of SNotes and is protected by copyright and other applicable laws. You may not reproduce, modify, or distribute any part of the Service without our prior written permission.

7. Subscriptions & Payment

SNotes currently offers a free waitlist period. When paid plans become available:

• Subscription fees will be billed in advance on a monthly or annual basis
• All prices are shown in EUR and include applicable VAT
• You may cancel at any time; cancellation takes effect at the end of the billing period
• Refunds are provided at our discretion, in accordance with applicable EU consumer law

8. Service Availability

We aim to provide a reliable and highly available service, but we do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance or updates, and will endeavor to provide advance notice for planned downtime.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SNotes shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Republic of Austria, excluding its conflict of law provisions. Disputes shall be subject to the exclusive jurisdiction of the courts of Linz, Austria, unless mandatory EU consumer protection laws require otherwise.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or via a notice within the Service at least 30 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
