Right of Withdrawal & Refund Policy

Information regarding the statutory right of withdrawal for consumers under the Austrian Distance and Off-Premises Contracts Act (Fern- und AuswĂ€rtsgeschĂ€fte-Gesetz – FAGG), consumer protection rules, and our cancellation and refund procedures.

1. Scope & Consumer Status

This Refund and Withdrawal Policy applies to all distance contracts concluded for the services of SNotes (operated by Paul Harrer, Austria) via our website or applications. Under the Austrian Distance and Off-Premises Contracts Act (Fern- und AuswĂ€rtsgeschĂ€fte-Gesetz – FAGG) and the Austrian Consumer Protection Act (Konsumentenschutzgesetz – KSchG), the statutory right of withdrawal applies exclusively to consumers (Verbraucher im Sinne des § 1 Abs. 1 Z 2 KSchG) — individuals entering into a transaction for purposes that are predominantly outside their commercial or independent professional activity. Business users and entrepreneurs (Unternehmer) do not possess a statutory right of withdrawal under Austrian law.

2. Statutory Right of Withdrawal

As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason (§ 11 Abs. 1 FAGG).

The withdrawal period is 14 days from the date of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Paul Harrer / SNotes, Email: [email protected], Austria) of your decision to withdraw from this contract by means of an unequivocal statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period of 14 days has expired (§ 11 Abs. 3 FAGG).

3. Effects of Withdrawal & Reimbursement

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (if applicable), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract (§ 14 Abs. 1 FAGG).

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement (§ 14 Abs. 2 FAGG).

4. Services Begun During Withdrawal Period & Digital Content

If you requested that the performance of services should begin during the 14-day withdrawal period (§ 10 FAGG), you shall pay us an amount which is in proportion to what has been provided until the time you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract (§ 16 Abs. 1 FAGG).

For contracts concerning the supply of digital content not delivered on a tangible medium, your right of withdrawal expires prematurely pursuant to § 18 Abs. 1 Z 11 FAGG if performance has begun with your prior express consent, your acknowledgment that you thereby lose your right of withdrawal once performance has begun, and our provision of confirmation in accordance with § 7 Abs. 3 FAGG.

5. Subscriptions & Regular Cancellation

The statutory 14-day right of withdrawal at the inception of a contract must be distinguished from the ongoing cancellation of recurring subscriptions:

  • You may cancel your recurring subscription (monthly or annual) at any time through your account settings or by contacting [email protected].
  • Cancellation takes effect at the end of your current paid billing period. You will retain full access to paid features until that date.
  • No subsequent recurring charges will occur after cancellation has been submitted.
  • Outside of the statutory 14-day withdrawal period or statutory warranty claims, partial refunds for unused days within an already started billing cycle are generally not granted.

6. Statutory Warranty for Digital Services (VGG & ABGB)

Independently of your 14-day right of withdrawal, you have statutory warranty rights under the Austrian Consumer Warranty Act (VerbrauchergewĂ€hrleistungsgesetz – VGG) and §§ 922 et seq. of the Austrian General Civil Code (ABGB). If SNotes experiences persistent non-conformity, major defects, or unannounced disruption that cannot be resolved, you have the right to have conformity established or, secondarily, to receive a proportionate price reduction or contract termination with a refund.

7. Payment Processing & Merchant of Record

Paid plans and transactions may be billed directly or processed through our authorized reseller and Merchant of Record, Paddle (Paddle Payments Ltd or Paddle.com Market Ltd). Refund requests may be submitted directly to SNotes at [email protected] or initiated through the Paddle billing receipt portal.

8. Model Withdrawal Form
